A Producer Company is a legally registered entity formed by a group of farmers or agriculturists with the primary objective of improving their income, livelihood, and access to resources through collective efforts.
As per Section 465(1) of the Companies Act, 2013, the provisions of the Companies Act, 1956 related to Producer Companies continue to apply. A Producer Company can be formed by:
- A minimum of 10 individual producers, or
- 2 or more producer institutions, or
- A combination of individuals and institutions (e.g., 10 individuals and 2 institutions)
The company must be established with a clearly defined objective related to agriculture or allied activities.
Procedure for Registering a Producer Company in India
- Obtain DSC and DIN
Apply for Digital Signature Certificates (DSC) and Director Identification Numbers (DIN) for all proposed directors. - Name Approval
Apply for name reservation through the MCA’s RUN (Reserve Unique Name) system. Once approved, incorporation must be completed within 20 days. - Draft MOA and AOA
Prepare and submit the Memorandum of Association (MOA) and Articles of Association (AOA) along with a declaration of purpose signed by all members. - Certificate of Incorporation
Upon successful verification, the Certificate of Incorporation is issued. The entire process typically takes about 10 working days.
